Move-in inspection checklist requirement

Reviewed by Marcus A. Hall, Founder
Standard clause
Common, reasonable, and usually fine to sign.
Quick answer

A move-in checklist protects your deposit. Fill it out thoroughly, photograph everything, and submit it within the deadline (usually 3–15 days). Some states require the landlord to provide one.

What it actually means

The move-in inspection checklist is the single most important document for getting your deposit back. It's your written record of every scratch, stain, chipped tile, and non-working outlet at move-in — so those can't be blamed on you months later.

States including WA, MI, KY, MA, and MT legally require the landlord to provide one and give you a chance to fill it out. Even where it's not required, always demand one, take date-stamped photos of every room and appliance, and email a copy to the landlord so there's a timestamped record.

What it looks like in a lease

"Within seven (7) days of the Commencement Date, Tenant shall complete and return the Move-In Inspection Checklist provided by Landlord. Any condition not noted on the Checklist shall be presumed to have been in good condition at move-in."

What to watch for

  • The deadline (3, 7, or 15 days is typical — anything shorter is aggressive)
  • Whether omitting an item creates a presumption against you
  • Whether the landlord signs / countersigns the checklist
  • State law: WA and MI require the landlord to provide it

How to negotiate it

Fine as written — but ask for the checklist upfront (not after you sign) and ask for 14 days to complete it. Photograph everything and email the completed checklist so there's a timestamp.

When it crosses into a red flag

  • No checklist provided
  • 48-hour return deadline
  • 'Landlord's assessment is final' language
  • Requirement to sign 'unit accepted in perfect condition' at move-in without inspecting

Frequently asked questions

What if the landlord won't give me a checklist?

Make your own. Walk through with a phone camera, capture every wall, floor, appliance, fixture, and window; date-stamp with a live time-clock app; email the photos and a written list to the landlord within a week of move-in. Keep the sent email.
